Terms of Service for BEN’S PLUMBING LLC Website and SMS Program.

Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the https://bens.plumbing Website (the “Website”) and the SMS/MMS mobile messaging program (the “Service”) operated by BEN’S PLUMBING LLC (“us”, “we”, “our”).

By accessing or using the Website or enrolling in our SMS Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Service Description

BEN’S PLUMBING LLC SMS Program: Users who provide their mobile number via web forms, in-person bookings, or by texting our number will receive automated and manual text messages related to:

  • Service Notifications: Appointment confirmations, reminders, and rescheduling options.
  • Billing and Payment: Billing details, payment confirmations, and overdue reminders.
  • Feedback Requests: Post-service completion surveys and service quality inquiries.
  • Emergency Updates: Timely alerts regarding plumbing-related emergencies or service disruptions.

2. Cancellation Policy

You can cancel the SMS service at any time. Just text “STOP” to our number. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time or text “START” to our number, and we will resume sending SMS messages to you.

4. Carrier Liability

Carriers are not liable for delayed or undelivered messages.

5. Message & Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your service activity and appointment schedule. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

7. Consent/Opt-in Requirements

By providing your mobile number and opting in, you attest that:

  • You are the account holder or have the account holder’s permission to enroll the mobile number.
  • You provide explicit electronic consent to receive the types of messages described in Section 1.
  • You acknowledge that “Message and data rates may apply.”

We maintain detailed records of consent, including timestamps, IP addresses (for electronic consent), and the specific language presented at the time of opt-in, for at least 5 years.

8. Messaging Policy and Compliance

BEN’S PLUMBING LLC treats all messaging as Application-to-Person (“A2P”) messaging subject to carrier guidelines and The Campaign Registry (TCR) requirements.

Every message sent will:

  • Clearly identify BEN’S PLUMBING LLC as the sender.
  • Match the registered use case approved by carriers.
  • Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA).

9. Prohibited Content

Users and staff are prohibited from using the Service to transmit:

  • Illegal content or promoting illegal activities.
  • Hate speech, harassment, or discriminatory content.
  • Phishing, spam, or deceptive content.
  • Cannabis-related content or high-risk financial services.

10. Right to Suspend Service

BEN’S PLUMBING LLC reserves the right to immediately suspend or terminate messaging services without prior notice if violations of messaging compliance are detected, or if the account is flagged for suspicious activity by carriers or The Campaign Registry.

11. Limitation of Liability

BEN’S PLUMBING LLC shall not be liable for any indirect, consequential, or punitive damages arising from the use or failure of the SMS Service. Our total liability for any claims related to these services shall not exceed the fees paid by the customer for such services in the 12 months preceding the claim.

12. Governing Law

These terms shall be governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

13. Modifications

We reserve the right to modify these terms at any time. Continued use of the Website or SMS Service after such modifications constitutes acceptance of the updated terms.
